Ben Aulich – an update from our Managing Partner
I appeared on behalf of Ben Aulich today in the ACT Magistrates Court for a mention of his matter. I reiterated our concerns that particulars of the charges against Ben have still not been provided by the prosecution and that the matter could not be progressed until they are provided.
As outlined in my April 12 blog, the ‘particulars’ of a criminal charge are when the prosecution clearly states the case they are trying to prove against a person. We have requested that the DPP particularise the charges on eight occasions and we still don’t have an answer. Ultimately, this is an issue of fairness to Ben in being able to adequately defend himself against the remaining charges (the most serious charge against him was withdrawn last month).
The prosecution advised that the particulars will be provided by the end of this week and the matter has been adjourned to 25 May 2021.
